FLORIDA PROBATE AND ESTATE ADMINSTRATION SERVICES and FLORIDA INHERITANCE LAW
In our Florida Probate and Estates practice, we represent individuals, heirs, beneficiaries, family members, and corporate fiduciaries when a loved one passes away leaving titled assets or Florida property in their name alone, such as a South Florida home or condominium. Our services include Formal and Summary Probate Administration, Ancillary Probate, Interstate Succession, Trust Administration and Estate Settlement throughout Florida, including Miami Dade County, Broward and Palm Beach County. Our staff is involved in all aspects of estate, probate and trust administration, including the asset distribution; handling creditors; beneficiary rights'; preparation of the federal and state tax returns; and complex postmortem estate planning. Florida law requires that virtually all estates have a probate attorney or probate law firm assist with the estate administration. As a Florida Probate Attorney and with a Master of Laws degree in Estate Planning, Attorney Barbara Buxton has the requisite experience to handle all probate and estate matters to settle an estate. We regularly work with out-of-state relatives to settle Florida estates.
FLORIDA ELDER LAW, FLORIDA MEDICAID PLANNING AND ELIGIBILITY SERVICES, NURSING HOME MEDICAID AND ASSET PROTECTION, GUARDIANSHIP, FLORIDA WILLS AND TRUSTS, DURABLE POWERS OF ATTORNEY, LIVING WILLS, DEEDS and DISABILITY PLANNING
Attorney Barbara Buxton is devoted to guiding families through the complex issues of elder law and Florida public benefits planning, including Florida Medicaid Planning and Qualification for Florida nursing homes and assisted living facilities, while helping them make informed choices to meet their needs. It is also important to consider that decisions made in one area of an elder's life can have unintended consequences in another. As part of our Florida Elder Law and Florida Medicaid practice, we develop plans to help senior citizens and disabled individuals qualify for and maintain government benefits, including Florida Nursing Home Medicaid, Assisted Living Medicaid, Hospice Medicaid and Veteran's benefits when they have too many assets or too much income for government benefits. We use techniques in Crisis and Advanced planning to legally preserve their assets and protect their family from the astronomical cost of nursing home and long-term care. It is never too early or too late to begin Florida Medicaid and Public Benefits planning, even if someone is already in a long-term care facility. Additionally, our plans can provide peace of mind through both Advance and Emergency Planning. Often times, individuals must become qualified for public benefit programs in order to fully protect themselves and their families from long term care and hospitals costs.
Ms. Buxton's goal as an Elder Law and Estate Planning Attorney with a Master of Laws degree (LL.M.) in Estate Planning, is to assist families in developing and implementing life plans that avoid probate and guardianship; plan for the possibility of long-term care; and protect their life savings if a nursing home or assisted living facility is needed. To reach appropriate answers and decisions, we take a multidisciplinary approach that involves determination of Florida Medicaid eligibility; drafting of wills and trusts, durable powers of attorney, healthcare documents and deeds; special needs planning; and estate planning. We also represent clients in Florida Emergency Temporary Guardianship, Florida Guardianship and Conservatoship when a senior does not have a Durable Power of Attorney and needs a guardian to be appointed by a Florida court.
