You may be eligible to be exempt from paying your Employer share of Social Security Tax (OASDI) on any “Qualified” employee that you have hired since February 3rd.
What makes your new hire “Qualified”? (must pass all of the following)
Employee is hired between February 3rd and December 31st of 2010.
Employee has been unemployed for the past 60 days, or has not worked for more than 40 hours during that time.
Not employed to replace another employee unless due to voluntary resignation or termination for cause.
Employee is not a relative of a 50% or more stock holder.
You are not a household employer.
In addition, if you keep the employee for 52 consecutive weeks you are eligible to take up to a $1,000 credit on your 2011 business tax return.
Simple... Ask your new hire if they worked more than 40 hours total in the last 60 days. If not, and they meet the other qualifications above, have them complete and sign a W-11 form and send it to your Payroll Specialist.
The FLSA establishes minimum wage, overtime pay, recordkeeping, and youth employment standards affecting employees in the private sector and in Federal, State, and local governments. Covered nonexempt workers are entitled to a minimum wage of not less than $6.55 per hour effective July 24, 2008; and $7.25 per hour effective July 24, 2009. Overtime pay at a rate not less than one and one-half times the regular rate of pay is required after 40 hours of work in a workweek. Many states also have minimum wage laws. Some state laws provide greater employee protections; employers must comply with both.
