PIP is a widely misunderstood term in Florida. Because this is not something implemented countrywide, Florida residents have a hard time finding the information they need. PIP stands for “Personal Injury Protection”. It is required under Florida law by drivers as part of their auto insurance coverage. Drivers must have a minimum of $10,000 worth of coverage on their policies to comply with the state rule.
Because Florida is a no-fault accident state, PIP is what covers injured motorists and ensures they receive some compensation. But, that does not mean it is your only option for recovering funds after an accident. Even with PIP, you may need car accident lawyers in West Palm Beach to assist you with filing a suit against the negligent party to recuperate some of the costs.
PIP is carried under your insurance policy and it is what your own insurance company pays to you after you are injured in an accident. These benefits are paid out regardless if you were at fault or the other driver was at fault. Because Florida is a no-fault state, insurance companies are not billed based on who caused the accident.
Your PIP insurance should cover 80 percent of your medical expenses and 60 percent of any lost wages. But, this coverage is only good up to $10,000. This means you are responsible for the remaining out-of-pocket costs and losses or you can sue the driver for the remainder.
PIP does cover all vehicle-related accidents, including if you were struck by a vehicle walking or riding a bike.
While you do have $10,000 in PIP coverage, this amount is often used up long before you even get to leave the hospital. An ambulance ride and a few diagnostic tests at the hospital will quickly use up the coverage you have – leaving you to pay the rest.
If you have PIP coverage, you likely will not have enough to cover your losses. But, car accident lawyers in West Palm Beach can help you recover costs of long-term care, your lost wages, and additional medical expenses by filing a civil lawsuit against the negligible party. Even though the state is “no fault” that doesn’t mean the negligent driver is not at fault for your expenses or injuries in civil court.
