Our lasr article in this gour part series touched on the PRR statute. Here we provide an overview of the HFO and HVFO statutes. Like the PRR statute, they are not invoked unless the accused person has at least one prior felony conviction (hence recividivist) and a pending felony charge. Unlike the PRR statute, the court has at least some discretion in deciding whether to sentence under the HFO or HVFO provisions where the person otherwsise qualifies. Both statutes increase the maximum penalty otherwsise authorized by law but the HVFO statute aslo imposes certain minimum mandatory sentences. In either scenario, the state is required to provide the defendant wih written notice of its intent to seek a sentence under either statute (where the defenant qualifies).
